New York City health officials are pushing a proposed regulation that would require parents to sign a consent waiver before they take part in a circumcision ritual called “metzitzah b’peh,” typically practiced by ultra-Orthodox Jews. The ritual potentially poses a fatal risk to newborns, according to the New York City Department of Health and Mental Hygiene.
The legislation was proposed at a Board of Health meeting last month by Dr. Jay K. Varma, deputy commissioner for disease control for New York City’s health department, after 11 infants contracted neonatal herpes between November 2000 and December 2011, after the circumcision ritual. Two of the infants died.
Jews regularly practice circumcision as part of their religion, but mostly ultra-Orthodox Jews practice metzitzah b’peh, during which the mohel, or person performing the procedure, orally sucks the blood from the infant’s newly circumcised penis.
A statement issued last month by the New York City Health Department notes that ten of the children who contracted herpes after the metzitzah b’peh were hospitalized. Of the eight who survived, two suffer from permanent brain damage. Approximately 2,000 infants per year undergo the metzitzah b’peh in New York City.
The Department of Health is accepting public comments on the proposed regulation until a public hearing July 23. At the hearing, there will be a public forum where the board will consider all comments and make a final vote September 13.

A German court has outlawed circumcision for non-medical reasons.
Circumcisions of young boys on religious grounds should be considered as grievous bodily harm, a German court has said, in a landmark ruling that clears up a grey area for doctors. The regional court in Cologne, western Germany, ruled that the “fundamental right of the child to bodily integrity outweighed the fundamental rights of the parents.” “The religious freedom of the parents and their right to educate their child would not be unacceptably compromised, if they were obliged to wait until the child could himself decide to be circumcised,” the court added. The case was brought against a doctor in Cologne, who had circumcised a four-year-old Muslim boy on his parents’ wishes. The doctor was later charged with grievous bodily harm but acquitted by a lower court which judged he had acted within the law as the parents had given their consent.
Jewish and Muslim groups are outraged.
“The Court’s decision is unacceptable and gravely violates religious freedom,” says Rabbi Aryeh Goldberg, vice president of the Rabbinical Center of Europe. “The decision is contrary to human rights charter of the European Union, to which the German legal system is committed, and undermines the basic right to worship in the German Constitution.”

New York City is investigating the death last September of a baby who contracted herpes after a “ritual circumcision with oral suction,” in an ultra-Orthodox Jewish ceremony known in Hebrew as metzitzah b’peh.
In a practice that takes place during a ceremony known as the bris, a circumcision practitioner, or mohel, removes the foreskin from the baby’s penis, and with his mouth sucks the blood from the incision to cleanse the wound.
The district attorney’s office in Kings County Brooklyn is investigating the death of the 2-week-old baby at Maimonides Hospital, but would not disclose the name of the mohel or whether there would be a prosecution.
“We are looking into it, that’s all I can say,” a D.A. source told ABCNews.com.
The 5,000-year-old religious practice is seen primarily in ultra-Orthodox and some orthodox communities and has caused an alarm among city health officials. In 2003 and 2004, three babies, including a set of twins, were infected with Type 1 herpes; the cases were linked to circumcision, and one boy died.
The mohel who performed the procedures, Yitzchok Fischer, was later banned from doing circumcisions, according to The New York Times. It is not known if he was involved in this recent death.

Owen Hopper says he definitely is circumcised, but the NYPD hearing officer ignored his smoking gun evidence and found him guilty anyway.
Hopper “submitted uncontested medical evidence and proof that his penis was circumcised and had been so since petitioner’s childhood,” his court papers complain.He was canned this past September, and is now suing to get his job back.
The alleged exposure incident happened sometime in 2010, when the unidentified woman was in a holding cell in the 19th Precinct station house on the Upper East Side. She said Hopper “exposed his penis to her and made vulgar and profane comments.”
His filing says she was “not credible” and made “various inconsistent statements” about the alleged incident, but “the key piece of evidence and testimony” had to do with “whether the petitioner’s penis was circumcised or uncircumcised.”

A Jewish Perspective and head of the Jewish Circumcision Resource Center website, says that many secular Jews now opt for a welcoming ceremony over a brit milah, or bris, by changing the ritual to omit the circumcision. “Many Jews are not aware that circumcision is a choice. It is psychologically easier to assume that there is no choice because it relieves the parents of dealing with the stress of making the decision and taking responsibility for it,” he said. “This is changing as more information becomes available on the Internet and elsewhere.
