Lindsay Lohan Jailed For 30 Days…….Or Not.

Lindsay Lohan will almost certainly get out of jail in a matter of minutes … this according to officials from the L.A. County Sheriff’s Department.
Two Sheriff’s Dept. officials tell us … if someone receives a misdemeanor sentence of 90 days or less, they are routinely processed in and then released. As one of the officials put it, “She’ll be out without even having to change her clothes.”
Judge Stephanie Sautner sentenced Lindsay to serve 30 days in the pokey, adding that the only way to shave time off the sentence is if it’s required by law. A Sheriff’s official told us earlier this week … misdemeanor inmates only serve 20% of the actual sentence because of overcrowding. But the 2 officials we spoke with today say … because of overcrowding they immediately release inmates sentenced to less than 90 days.
As for what the judge said — that the sentence can only be reduced if required by law — the officials say there’s a federal court order on overcrowding that “trumps everything,” and that order has been interpreted to immediately release people with short jail sentences.
Lindsay Lohan Gets One Month Reprieve
There was a buzz in the case that Judge Elden Fox would have Lindsay jailed tomorrow — without giving her bail — and make her sit behind bars for 30 days until the next hearing. The danger for Lindsay — she would have to serve the full 30 days and would not be released early because of jail overcrowding.
But insiders tell TMZ … if Judge Fox remands Lindsay into custody he must set bail, because the underlying offenses are all misdemeanors.
So here’s the way it will go down … Our sources say tomorrow’s hearing will be extremely short. There won’t be any arguments over the case. Judge Fox will schedule the formal probation violation hearing, and almost certainly remand Lindsay into custody and then set bail. But you can bet a bail bondsman will be right there in the courtroom to take care of business on the spot. So Lindsay will walk out a free woman tomorrow.
When the probation violation hearing is held next month, it’s likely Judge Fox will sentence Lindsay to 30 days in jail based on the failed drug test for cocaine. As we first reported, the Probation Department will not recommend jail time for the second failed drug test because of an ambiguity in the paperwork.
But this 30-day sentence would be subject to the realities of jail overcrowding, which means Lindsay would go to jail for booking and probably be released an hour or two later.
The upshot — looks like Lindsay will dodge another bullet.
Lindsay Lohan’s Probation Cancelled – Bench Warrent Issued.
This could be a good thing. So she is looking at 30 days in jail, as that is what the new judge told her she would get if she failed another drug test. TMZ reports that Blohan’s judge has officially revoked her probation and has issued a bench warrant for her arrest. Her next court date isn’t until Friday morning so the judge is giving her until then to turn herself in. The party don’t stop until Nana Lohan turns off the strobe machine!
The judge threw down the arrest warrant after LiLo tested positive for coke and amphetamines (probably Adderral or meth) in at least two drug tests. LiLo admitted to having issues with the bad shit and said she will accept any consequence that comes her way. If the judge isn’t made of lies, he will throw her in the clink for 30 days.
